Applicability

These terms apply to all training, education and advisory services from IEMT Training (Mitchel Heitinga) to individual participants, in-company clients and collaboration partners, unless agreed otherwise in writing. Terms and conditions from customers do not apply.

Nature of the service

The service concerns education and training. The work does not fall under the Dutch Quality, Complaints and Disputes (Care) Act (Wkkgz) or the Medical Treatment Agreement Act (WGBO). I am not a BIG-registered care provider and I do not give a medical or psychological diagnosis. The engagement is an obligation of means aimed at the transfer of vocational competence; certification follows from an assessment against the criteria of The Association for IEMT Practitioners and is not guaranteed. Before a training begins, you receive a participant agreement in which this framework is set out explicitly.

Fees and payment

Current fees are listed on the business page and on your individual quote. Fees are charged VAT-free on the basis of [VAT basis — to be confirmed by accountant]. Invoices are settled within 14 days of the date of issue, unless agreed otherwise in writing. Late payment carries the statutory consumer or commercial interest rate, plus reasonable collection costs in accordance with the Dutch Decree on Reimbursement for Extrajudicial Collection Costs.

Cancellation

For open training editions: free cancellation up to four weeks before the first training day. Cancellation between four and two weeks before the start attracts 50 per cent of the fee; cancellation within two weeks or without notice 100 per cent. A booked place may be transferred to an equivalent participant (subject to agreement).

For in-company engagements: a separate schedule of arrangements in the engagement confirmation. Default: free rescheduling up to eight weeks before the first training day; between eight and four weeks 25 per cent, on a stepped scale; within four weeks 75 per cent; within two weeks 100 per cent.

If the trainer falls ill, a replacement date is offered. In the event of illness or unforeseen circumstances on the part of a participant: by agreement, with reasonableness on both sides and — where possible — a place in a subsequent edition without additional cost.

Confidentiality

What is discussed during training blocks and supervision hours between participants and trainer remains confidential within the group. I share no content with third parties without explicit written permission. For in-company engagements, reporting arrangements with the client are agreed in writing in advance — as a rule the client receives confirmation of participation, completion and — in the case of a certification programme — outcome. Substantive details about individual participants are not shared with the client.

Case studies and video recordings that participants submit for certification are used only for the Association assessment. Clients in the case-study work give written permission and know their session is being used as a case study; identifying data are not recorded.

Liability

Liability is limited to the amount paid out by the professional liability insurance in the case at hand, plus the excess. If no payment is made, liability is limited to the amount paid for sessions in the three months preceding the event. Indirect damages, consequential damages and lost profits are excluded, within what is permissible under applicable law.

Privacy

Processing of personal data is handled in line with the privacy statement. You hold all rights under the GDPR (access, correction, deletion, portability, objection), and may lodge a complaint with the Dutch Data Protection Authority.

Complaints and disputes

If you are dissatisfied, please raise it directly with me first. I respond within 10 working days and aim to resolve matters in dialogue. If we cannot work it out together, the following routes are available:

The full complaints procedure is available on request. Applicable law: Dutch law. Competent court: the district where the trainer is established, unless mandatory law provides otherwise.

Wkkgz

IEMT Training consciously falls outside the Wkkgz: this is education and training outside the care framework. I enter into no care agreement, give no diagnoses and provide no medical treatment. Participants who apply IEMT in their own practice are themselves responsible for the legal framing of their client work.

Intellectual property

The training material (slides, handouts, videos, case write-ups) is protected by copyright. Participants may use the material for their own development and in their own client work; redistribution, commercial use or integration into one's own training material is not permitted without written permission. For in-company engagements a separate content licence can be agreed.

Certification

On successful completion of a live training plus submission of two case studies and a video recording in accordance with the criteria of The Association for IEMT Practitioners, certification as an IEMT Practitioner follows. Certification is not transferable, does not lapse over time, and may be withdrawn in case of serious breach of the Association's professional standards. Changes

These terms may be adjusted when legislation, regulation or practice makes that necessary. For live engagements, the version in force at the moment of signing applies, unless agreed otherwise in writing.
